PLEASE READ THESE TERMS CAREFULLY. BY ACCESSING OR USING THE VETSY PLATFORM, YOU ENTER INTO A BINDING LEGAL AGREEMENT WITH VETSY AND AGREE TO BE BOUND BY THESE TERMS IN THEIR ENTIRETY.
Article I — Definitions
In these Terms of Service ("Terms"), unless the context otherwise requires:
- "Vetsy" means the Vetsy platform, its founders, employees, affiliates, and agents.
- "Platform" means the Vetsy mobile application, website, and all associated technology services.
- "User" or "You" means any person accessing or using the Platform.
- "Services" means doorstep veterinary care, including consultation, examination, vaccination, and related services, facilitated through the Platform.
- "Veterinary Professional" means a licensed veterinarian or veterinary technician engaged through the Platform as an independent service provider.
- "Booking" means a confirmed appointment for Services, accepted by a Veterinary Professional through the Platform.
Article II — Acceptance of Terms and Eligibility
By accessing or using the Platform, you represent and warrant that you are at least 18 years of age, are legally competent to enter into a binding contract under the Indian Contract Act, 1872, and unconditionally accept these Terms.
If you access the Platform on behalf of another individual, you represent that you are duly authorised to bind that individual to these Terms.
Article III — Nature and Scope of Vetsy's Role
Section 3.1 — Technology Facilitation Platform
Vetsy is a technology-enabled facilitation platform. Vetsy connects pet owners with independent licensed veterinary professionals. Vetsy does not itself provide veterinary medical services, diagnosis, treatment, or clinical advice of any kind. The Platform is a marketplace and coordination tool; it is not a veterinary clinic.
Section 3.2 — Credential Verification; No Guarantee of Quality
Vetsy verifies that all Veterinary Professionals listed on the Platform hold valid registration under the Indian Veterinary Council Act, 1984, with the Veterinary Council of India or the relevant State Veterinary Council. This verification is conducted at the time of onboarding.
Verification of credentials is not, and shall not be construed as, a guarantee, warranty, or representation of the quality, standard, or outcome of any veterinary care provided. The professional quality of clinical services rendered is the sole and exclusive responsibility of the individual Veterinary Professional. Vetsy accepts no liability whatsoever for clinical outcomes, treatment decisions, or quality of care.
Section 3.3 — Independent Practitioners
Veterinary Professionals providing Services through the Platform are independent service providers and are not employees, agents, partners, or representatives of Vetsy. Vetsy is not responsible and shall not be liable for any act, omission, advice, diagnosis, prescription, or clinical decision of any Veterinary Professional.
Section 3.4 — No Emergency Medical Services
THE PLATFORM IS NOT AN EMERGENCY SERVICE. IF YOUR PET REQUIRES URGENT OR EMERGENCY VETERINARY ATTENTION, CONTACT YOUR NEAREST EMERGENCY VETERINARY HOSPITAL IMMEDIATELY. VETSY SHALL NOT BE LIABLE FOR ANY HARM, INJURY, LOSS, OR DEATH RESULTING FROM RELIANCE ON THE PLATFORM IN AN EMERGENCY SITUATION.
Article IV — User Obligations and Conduct
By using the Platform, you agree to:
- Provide accurate, truthful, and complete information when registering and booking
- Maintain the security and confidentiality of your account credentials
- Ensure your premises are safe and accessible for visiting Veterinary Professionals
- Adequately restrain pets that may present a risk of harm to the Veterinary Professional
- Treat Veterinary Professionals with professional courtesy and respect
- Not request services outside the scope of what is offered through the Platform
- Comply with all applicable laws of India, including those governing animal ownership in Assam
- Not use the Platform for any fraudulent, unlawful, or unauthorised purpose
Article V — Booking Confirmation and Service Delivery
A booking request submitted by a User is routed to available Veterinary Professionals in the relevant area. A confirmed Booking exists only when a Veterinary Professional accepts the request through their Vetsy dashboard and the User receives a confirmation notification. Vetsy does not guarantee the availability of any specific Veterinary Professional or any specific appointment time.
Vetsy reserves the right to decline, cancel, or modify any booking at its sole discretion, including where safety concerns, unavailability, or other operational constraints exist.
Article VI — Payment Terms
Vetsy operates on a pay-after-visit model. Payment for Services is due after the veterinary visit has been completed. The applicable service fee will be communicated to the User prior to or at the time of service delivery. All applicable taxes, including Goods and Services Tax (GST), shall be charged as required by law.
Vetsy reserves the right to revise its service fees at any time. Revised fees will be communicated to Users prior to application on new bookings.
Article VII — Limitation of Liability and Disclaimer of Warranties
Section 7.1 — Disclaimer of Warranties
THE PLATFORM AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. VETSY MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR UNINTERRUPTED AVAILABILITY.
Section 7.2 — Zero Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VETSY'S TOTAL AGGREGATE LIABILITY TO ANY USER, ARISING UNDER ANY CAUSE OF ACTION — WHETHER IN CONTRACT, TORT, STATUTE, EQUITY, OR OTHERWISE — IN CONNECTION WITH THESE TERMS, THE PLATFORM, OR THE SERVICES, SHALL BE ZERO (INR 0). THIS IS AN ABSOLUTE AND UNCONDITIONAL LIMIT.
Section 7.3 — Exclusion of Consequential and Incidental Damages
Under no circumstances shall Vetsy be liable for any of the following:
- Indirect, consequential, special, incidental, or punitive damages
- Loss of profits, revenue, data, or business opportunity
- Death, bodily harm, or injury to any animal or person arising from veterinary care
- Any act, omission, negligence, or misconduct of any Veterinary Professional
- Failure, delay, or unavailability of the Platform for any reason
- Unauthorised access to or alteration of User data
- Losses arising from force majeure events, including natural disasters, government directives, or infrastructure failures
Section 7.4 — User Assumption of Risk
You expressly acknowledge and agree that your use of the Platform and the Services facilitated thereby is entirely at your own risk. Vetsy's role is limited to technology facilitation; all risk arising from veterinary care is borne exclusively by the User and the Veterinary Professional.
Article VIII — Indemnification
You agree to indemnify, defend, and hold harmless Vetsy, its founders, officers, employees, and agents from and against any and all claims, proceedings, losses, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your breach of any provision of these Terms; (b) your violation of any applicable law or regulation; (c) any content or information you submit through the Platform; or (d) any third-party claim arising from your use of the Platform.
Article IX — Intellectual Property Rights
All intellectual property rights in and to the Platform — including the Vetsy name, logo, design, software, and original content — are and shall remain the exclusive property of Vetsy or its licensors. Users are granted a limited, non-exclusive, revocable, non-transferable licence to access and use the Platform solely for its intended purpose. No right, title, or interest in any Vetsy intellectual property is transferred to the User.
Article X — Platform Modifications and Availability
Vetsy reserves the right to modify, suspend, or discontinue the Platform, or any feature thereof, at any time without prior notice. Vetsy shall not be liable to any User for any loss or inconvenience resulting from such modification, suspension, or discontinuation.
Article XI — Third-Party Links and Services
The Platform may contain links to or integrations with third-party services. Vetsy does not endorse and is not responsible for the content, accuracy, privacy practices, or reliability of any third-party service. Your use of any third-party service is governed exclusively by that service's own terms and policies.
Article XII — Account Suspension and Termination
Vetsy may, in its sole and absolute discretion, suspend or terminate any User account at any time, without prior notice and without liability, for breach of these Terms, misuse of the Platform, or any other reason Vetsy deems appropriate. Termination does not affect any rights or obligations that accrued prior to termination. Articles VII, VIII, IX, and XIV shall survive termination.
Article XIII — Force Majeure
Vetsy shall not be in breach of these Terms, nor shall it incur any liability, for any delay or failure in performance of its obligations resulting from events or circumstances beyond its reasonable control, including but not limited to natural disasters, acts of God, epidemic, pandemic, government actions, telecommunication failures, or power outages.
Article XIV — Governing Law, Jurisdiction, and Dispute Resolution
Section 14.1 — Governing Law
These Terms are governed by and shall be construed exclusively in accordance with the laws of India, including the Indian Contract Act, 1872, the Consumer Protection Act, 2019, and the Information Technology Act, 2000.
Section 14.2 — Dispute Resolution
Any dispute, claim, or controversy arising out of or in connection with these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the competent civil courts in Guwahati, Assam, India. Prior to commencing legal proceedings, the parties agree to attempt good-faith resolution of the dispute by written notice, allowing 30 days for response and informal settlement.
Article XV — Severability and Entire Agreement
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable. All remaining provisions shall continue in full force and effect. These Terms, together with the Privacy Policy and Cancellation Policy, constitute the entire agreement between the User and Vetsy with respect to the subject matter hereof.
Article XVI — Grievance Officer and Contact Information
In accordance with the Consumer Protection Act, 2019, and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the following officer has been designated to address User grievances:
